Rape – Penal Code 261 PC,- Rape, as defined under section 261pc is an act of sexual intercourse with someone who is not the spouse of the perpetrator, under circumstances that severely compromise consent. This includes situations where the victim is incapable of legal consent due to a mental disorder, developmental or physical disability, intoxication, unconsciousness, or through the use of force, violence, or threats.

Penal Code 288 PC – Lewd or lascivious acts –,- California Penal Code § 288 PC prohibits lewd and lascivious acts with a child. 

Penal Code 288(a) as: a lewd or lascivious act; committed on the body or part of a child under 14 with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of the child or perpetrator.
