Penal Code § 273.5(A) PC FELONY – it is unlawful to cause physical injury to a spouse, cohabitant, dating partner or parent of one’s child through an act of domestic violence. This offense is also referred to as domestic abuse, spousal battery, or corporal injury to a spouse or cohabitant.

Penal Code 243(E)(1) PC- MISDEMEANOR
defines domestic battery as using force or violence against a cohabitant, the other parent of your child, or a current or former spouse, fiancé, fiancée, or dating partner. abuse or violence means the defendant applied physical force, or offensive touching, against the alleged victim, and there is no legal justification for the defendant’s actions. offensive touching does not have to cause pain or injury as long as the touching was done in a harmful or aggressive manner and without legal justification.
